What Is Producer Company?
A producer company is defined under the Companies Act of 2013 as a form of Company that is launched by a group of individuals primarily engaged in production, procurement, handling, pooling and marketing agricultural products. Here, the primary produce includes farmers’ products, ranging from horticulture to animal husbandry, along with any other produce defined under the Central government. A Producer Company can be formed by 10 individuals (or more) or 2 institutions (or more) or by a combination of both (10 individuals and 2 institutions) as members with atleast 5 directors having their business objective as specified under the Act. It’s a hybrid between Cooperative Societies & Private Limited Companies registered under the Companies Act.

- Hybrid Structure: A Producer Company combines the professional management of a Private Limited Company with the mutual benefits of a Cooperative Society.
- Perpetual Succession: A Producer Company has perpetual Succession , that is continued or Uninterrupted existence until it is legally dissolved. A producer company being a separate legal person, is unaffected by the death or other departure of any member but continues to be in existence irrespective of the changes in membership .
- Separate Legal Entity:A Producer Company is a distinct legal entity from their members. The Company can acquire assets and incur debts under its own name and the Directors of the Company have no obligation to the lender of the Company.
